Michigan Supreme Court and Stare Decisis - Tuesday, March 2


From Mark Brewer, MDP Chair: Election season is upon us and we have a lot of work to do. One of our top priorities is to defeat Justice Bob Young on the Michigan Supreme Court.

For too long, Justice Bob Young has ruled to protect greedy corporate CEOs, insurance companies, and workplace sex offenders. He has used his power on the bench to dictate policy and not do what's best for Michigan and its residents.

But you don't have to take my word for it. Check out this upcoming event in March in which a Wayne State University Law School Professor analyzes the Court and some of its decisions over the past decade.

We can't afford to let Bob Young continue to hurt Michigan. Let's unite to defeat him in November.

Professor Sedler will discuss his study of the Court's 1999-2008 jurisprudence, including many decisions overruling previous precedent, and the effects on tort law, employment law, criminal law and more.

Based on his conclusion that the Michigan Supreme Court's decisions lack legitimacy, Professor Sedler will discuss arguments and strategies available to those litigants who may wish to ask the current Supreme Court to "overrule the overrulings" by the prior Supreme Court.

In particular, Professor Sedler argues:

"What has happened in Michigan, pure and simple, is that a majority of the Justices on the Michigan Supreme Court have used their power to overrule prior decisions with which they disagreed, in order to make significant changes in Michigan's tort law in favor of defendants over plaintiffs, significant changes in worker's compensation law in favor of employers over workers and significant changes in criminal law in favor of prosecutors over defendants. In so doing, the Court majority has led the Michigan Supreme Court to abandon stare decisis..."
